I'm glad it happened. I think Apple's secrecy sucks. But even more sucky is Apple's deliberate dissemination of misinformation. I think their behavior in this regard arguably violates the securities laws.

The leak hasn't helped their stock today, which is currently down 1.77%.

And Jacob, I'm not saying that I disagree with you, only that if Apple really cared there would be an injunction in place already and his holy Jobses would have rained down all manner of plague upon them.

Does anyone believe this isnt a deliberate leak from Apple? Phones dont just walk away on their own.
People leave their phones at bars all the time. Especially if they had it out and showing it off. Hey look, I have a phone that no-one else has -- documentably.

Happy to have you pick this thing up. Was burning a hole in our pockets. Just so you know, we didn't know this was stolen [as they might have claimed. meaning, real and truly from Apple. It was found, and to be of unproven origin] when we bought it. Now that we definitely know it's not some knockoff, and it really is Apple's, I'm happy to see it returned to its rightful owner.

P.S. I hope you take it easy on the kid who lost it. I don't think he loves anything more than Apple.

Small fucking world. The guy that lost the phone is from my small home town, went to my high school, and my college. I know his family and seen him around plenty before.

Well, I'd say he's now a small Internet celebrity.

I am losing a bit of respect for Gizmodo in all this. I understand the desire to break the story and be the first out of the gate but their flippant reply to Apple's letter does not sit well with me.

Yeah. I agree with Nate here. Also the last part of this statement seems kinda off to me as well.

(Our legal team told us that in California the law states, "If it is lost, the owner has three years to reclaim or title passes to the owner of the premises where the property was found. The person who found it had the duty to report it." Which, actually, the guys who found it tried to do, but were pretty much ignored by Apple.)

And why is gizmodo all over TV?!? :confused:

Gizmodo has always been run by assholes.

Never liked them and only checked out their site when i was extremely bored or for their live blog while an Apple keynote is happening. Fact that they are owned/ran by the same dip shits at Gawker brings up the question "how anyone in their right mind think these people are respectable?" to me. i also never liked being linked to their porn blog from reading gizmodo regardless of their NSFW warnings (its not even a decent porn blog at that).

I have liked Jason Chen's live blog comments though, he seemed to be a laid back funny dude but in his video with the prototype phone makes him look like a complete nutsack for even being involved in this.

I love the Apple rumor mill as much as anyone else, its interesting to wonder and think what is coming out next. the Apple rumor mill reminds me of a conspiracy theoriest way of life..but what happened to this prototype iPhone is like a conspiracy theory coming true, which ruins all the fun in the rumor mill and it ruins all the wonder.. in other words what makes the rumor mill fun is NOT KNOWING AND WAITING. so as now i stand here just bored at this story, big whip! we all knew the next gen iPhone would have a front camera and better back camera with flash, this has been proven from the dev's digging into the 4.0 SDK. and anyone with common sense could of told you Apple was going to do a body redesign some how some way.

Jizmodo is now trying to make themselves look good, even know they knew who's product this was and willing bought it. what they did from the purchase to naming the poor dude who lost it is not only unethical in everyway possible but proves how much of lowlife cocksuckers these people are. I hope Apple waits to see if there is any less long term financial damage from this and sue the shit out of everyone involved once the phone was lost.

if Apple does fire the dude who lost it he will never get another job in the industry again cause Jiz had to name him and post his pics..seriously!?! why did they have to go that far?

ugh low lifes really piss me off, esp when they have to screw with other peoples jobs and families. would not be surpised if Gizmodo never gets a keynote invite again.

been watching this drama series since engadet posted the first pics..i do check them like 5 times a day on my phone when im bored.

i want to preorder the phone now! when Toshiba's 2.5 12mm laptop hdd comes out to buy i will be purchasing my first macbook pro 13 (only 1tb option out in the 2.5 12mm is WD and i cant stand their drives).

Just to offer a bit of counterpoint, I have zero problem with Gizmodo. Sure, they're talking out of both sides of their mouth to an extent. "We'll be happy to return the iPhone ..." (...now that we're done with it, but if you had asked us when we first got it, you might have gotten a tad more reticence than you're getting now).

But jeez, c'mon, they're journalists, in a world where "first unboxings" -- especially of something like the Next Big Thing From Apple -- is like the holy grail of journalism.

And I didn't read their reply to Apple as "flippant" -- just "couched". They even went so far as to throw a good word in for their unintended victim. Which is about all they can do, short of returning it to him. I think that's why they phrase it the way they do -- they want them to know that they want to return it to the person from whom it was taken.

And I don't see this as career-ruining -- it was a mistake, a big one, and the dude needed to be called on it. I'm betting Apple keeps him, or he finds another job. Jeez, he can program microcode, cocky enough to test it himself in the field. He can't be too bad. I'd hire him.

But it's all moot. The Princess of Kansas has declared that the issue be resolved by cockfight (titter), anyway, so wait for the carnage.

I'm w/ Dusty. This whole thing has been extremely amusing. Especially the reactions of the fanboy army.

Steve Jobs could stroll up and poke his eye out and the fanboy would author a post as to how it was completely reasonable given the circumstances.

Then he would happily buy his eye back from him.

I wonder how different the reactions would be if it was Microsoft that had been Gizmodo'd thusly.

The naming of the poor sap will likely be what keeps his job for him. Would be bad PR to fire him now.

And like they would not have found out anyway.
