Obama will appoint someone. The Senate will not confirm while he's President. He'll have an interim Justice ready to appoint when the Senate is out of session. The GOP will figure out a way to always be in session. Who breaks ties in the SCOTUS?  I guess the lower court ruling that was appealed to the SCOTUS would still stand... never was too excited about my con law classes.
